Article 1- Definitions and general notions

The different notions to which these conditions refer must be interpreted with regard to the Recommendation of the Commission on Abusive Clauses and the common law applicable to rental contracts governed, in Tunisian law, by articles 726 and 727 of the Code of Obligations and contracts. The rental contract is concluded intuitively personae and cannot be the subject of a transfer. “You”, “the tenant” means the drivers and payers mentioned on the rental contract and signatories thereof who have the status of tenant. “We”, “the lessor” means the Company Enjoy car, whose company name appears on the Rental Agreement. “The vehicle” means a Passenger Car or Commercial Vehicle that we rent to you for the agreed duration of the Rental Agreement.

“Damage”: any damage to the vehicle is considered damage, including broken glass, the latter including the headlights, mirrors and headlights. “Theft”: is assimilated to the theft of the vehicle: vandalism, theft of accessories and attempted theft. “Tunisia” designates the country in which the rented vehicle can travel. Circulation outside Tunisia is prohibited, unless expressly authorized by Enjoy car

Article 2 – Conditions to be met to rent a vehicle

You must provide us, with supporting documents, with all the information essential to establishing your rental contract and in particular: your identity (passport), your address (home and e-mail), your landline telephone contact details, number, date of issue and expiration of your driving license as well as its place of issue, the means of payment for your rental. If this data is not communicated, the reservation request cannot be validated.

Article 3 – The vehicle

Article 3.1 – Condition of the vehicle

A descriptive statement of the vehicle is attached to your contract. You undertake to note in writing, before your departure from the station, any apparent defect which is not included therein. Failing this, we are deemed to have delivered a vehicle conforming to the description. Unfortunately, we will not be able to take into account complaints concerning apparent damage which has not been reported at the time of departure. You must return the vehicle in the condition you received it. Any repair costs, resulting from a fault on the part of the tenant, will be added to the cost of the rental, subject to the stipulations in the “optional contractual guarantees” section.

Article 3.2 – Use of the vehicle

You must never drive the vehicle anywhere other than Tunisia. In accordance with the principle of personality of penalties, you are responsible for offenses committed during the rental period. Thus, you are informed that your contact details may be communicated to the police, national guard or judicial authorities who request them.

You undertake to use the vehicle as a “good father” and in particular, without being under the influence of alcohol or narcotics or any substance likely to affect driving in accordance with the provisions of the Highway Code and to use it in accordance with its intended purpose. , which, for a private vehicle, is mainly that of the transport of people free of charge and for a utility vehicle, is mainly that of the transport of goods.

We particularly draw your attention to the dimensions of utility vehicles which require increased attention during certain maneuvers (reverse gear for example) and can make it impossible to cross certain road infrastructures (tunnels, bridges, etc.), including the height maximum is, according to the regulations in force, indicated in advance.

CAUTION: In case of incorrect assessment of the size of the vehicle.

Upper body and lower body impacts are not covered by the damage guarantee unless force majeure can be proven. You must not use the rented vehicle in particular:

  • to be re-let; ;
  • for the transport of people for payment;
  • for the transport of a number of people greater than that mentioned on the vehicle’s registration document;
  • to participate in rallies, competitions or tests, whatever the location;
  • to give driving lessons;
  • to push or pull another vehicle (except vehicles equipped with a hook – maximum load 1000 kg);
  • on non-motorable roads or whose surface or state of maintenance presents risks for the tires or the components under the vehicle;
  • to commit an intentional offense.


The goods and baggage transported in the vehicle, including their packaging or stowage, must neither damage the vehicle nor expose its occupants to abnormal risks.

When you park the vehicle, even for a short stop, you agree to lock the vehicle. You should never leave the car unoccupied with the keys in the ignition.

Failure to return the keys will result in forfeiture of the theft guarantee. In the event of damage or theft, you must send the rental company, as soon as possible, the amicable accident report or the theft declaration receipt given by the authorities, as well as the vehicle’s keys and papers.

A breach of the rules mentioned above will result in invoicing of the vehicle.

PLEASE NOTE: article 3-2 sets out the minimum obligations to be respected during the period during which you have custody of the vehicle.

Article 3.3 – Maintenance / mechanical problems

During your rental and depending on the number of kilometers traveled, you will have to carry out the usual checks (coolant level, engine oil level beyond 1000 km, tire pressure, etc.), in accordance with the usage of a “good father of a family”.

As such, the Renter will remain vigilant to any signal emitted by the warning lights appearing on the vehicle dashboard and will take all necessary precautionary measures, if necessary, such as emergency stopping.

The vehicle is supplied to you with five tires whose condition complies with road regulations. In the event of deterioration of one of them for a cause other than normal wear, hidden defect or case of force majeure, you undertake to replace it immediately and at your expense with a tire of the same size, same type. , same brand, and equal wear. In the event of a mechanical breakdown only (excluding accidents), you benefit from an Assistance Service, included in the price of your rental.

The conditions of this assistance are explained to you in article 8 below “Conditions of Insurance, Assistance and Useful Advice”.

PLEASE NOTE: ENJOYCAR does not undertake to provide you with a car of a specific model or specific color and reserves the right to make modifications if necessary and of course in the event of a breakdown. However, we guarantee the category of your choice and in the event of unavailability a higher category.


Article 4 – Duration of the rental

Article 4.1 – Concept of calculation

The lessee undertakes to return the vehicle to the lessor on the day and at the time stipulated in the rental contract under penalty of being exposed to civil and criminal legal proceedings as well as the invoicing of late fees. A franchise of 179 minutes is granted. A maximum of two (2) additional hours may be billed. Beyond these five hours, a full day will be billed


PLEASE NOTE: There is no refund for any rental shorter than the duration provided for in the reservation.

Article 4.2 – End of rental

We undertake to give you the guarantee deposited for the car rental at the same time as you give us the keys to the car and that the latter is in good condition (in its initial condition indicated on the contract) the car must be delivered to the delivery location mentioned during the reservation and any modification will be charged from €20 to €40 (it depends on the new delivery location)

In the event of an accident, the rental contract is terminated upon transmission to the rental company of the amicable report duly completed by the tenant and any third party.

Article 5 – Payment

Article 5.1 – The price

The rental price is the same indicated on our site: www.enjoycar-tunisie.com  no additional costs or taxes will be requested from the renter. Payment is made in cash upon delivery of the car

FREE: baby seat, additional driver, delivery and return of the vehicle anywhere in Tunisia but this must be mentioned when booking and not during the rental of the car (we cover practically the entire Tunisian territory (bizerte, tunis, tabarka, Hammamet, Sousse, Monastir, Djerba, Enfidha…) as well as all international airports (Tunis Carthage airport, Zin el Abidin Ben Ali airport, Enfidha airport, Monastir airport, Djerba airport)

Article 6 – Insurance and assistance conditions

Article 6.1 – CIVIL LIABILITY INSURANCE

All vehicles in the Enjoy car fleet are insured for bodily injury and material damage that you may cause to third parties following an accident involving said vehicle, in order to satisfy the insurance obligation.
Insurance for transported persons:

It covers the driver and all his passengers in the event of an accident linked to the use of the vehicle. This insurance provides for the reimbursement of certain medical expenses as well as the payment of capital for death or permanent disability.

ATTENTION: in order not to be excluded from the benefit of the guarantee, you must respect the geographical traffic limitations mentioned in article 3-2.

You must also respect the obligations of the general rental conditions relating to the driving of the vehicle, in particular those relating to the driving license, compliance with safety conditions and the prohibitions relating to participation in rallies, competitions or tests, the use of trailers or towing other vehicles, and the transport of people for a fee. Otherwise, if the driver’s liability is engaged, the insurer reserves the right to take recourse in its name or ours against said driver and/or the lessee of the vehicle.

Article 6.2 – Assistance conditions – troubleshooting

You benefit, for the duration of your rental agreed with Enjoy car at no extra cost, from a minimum Breakdown and Assistance service, linked to the use of the vehicle, in the event of a mechanical breakdown only. In the event of an accident, we provide a breakdown service from 8 a.m. to 10 p.m. throughout Tunisia and especially in tourist towns such as Hammamet, Tunis, Sousse, Monastir, Enfidha.
